Slip Trip Fall

Falls are a leading cause of serious injury and death. All businesses owe a duty to their patrons to maintain their premises in a safe condition. Unfortunately, when the ball gets dropped, people get injured in a variety of ways: floors which are too slippery when wet or when dry; obstructions on store aisles, such as boxes or debris. Stores have a duty to reasonably inspect and clean walking surfaces to protect the public.

When someone is injured by a trip or slip and fall, it is not necessarily the fault of the owner of the premises. Your attorney must conduct a thorough investigation and will frequently consult with an engineer or expert familiar with building code and safety standards applicable to the case. Delay in consulting with a qualified attorney can be detrimental to your case.

One of my early slip and fall cases involved a concussion suffered by a young woman at an outdoor area of a Waikiki hotel on a rainy day, less. I took a photographer and safety consultant to the accident some weeks later in the early morning, at the same time my client was injured. It was raining that day. At the site, we observed warning signs had been placed in several puddles advising “slippery when wet.” No signs were posted on the date of my client’s fall. We also observed algae present in the puddle areas, which suggested a more longstanding problem. An algologist at the University of Hawaii was also retained as one of our experts. The case was later successfully settled.
